Terms of Service Overview: By using Pro Certify Crew services, the customer agrees to these terms and conditions:

Terms Of Service

Acceptable Use Policy for Terms of Service:

  • User agrees to use the service in compliance with all applicable laws. Pro Certify Crew reserves the right to cooperate with law enforcement if the account violates any laws.
  • User agrees to follow the Acceptable Use Policy of any network they connect to, including Pro Certify Crew system.
  • Neither PBCOPL nor its Information Providers are responsible for any damages from User’s use or inability to use PBCOPL service.
  • User agrees that submitted material on PBCOPL does not infringe on others’ rights or contain obscene or libelous content. Users may not host any hardcore adult content or pornographic websites on our shared or reseller servers. Pro Certify Crew prohibits the storage of software intended for violations or infringements.
  • Violations of netiquette may lead to immediate service suspension and account termination upon investigation by Pro Certify Crew.
  • Posting similar or off-topic articles to 20+ newsgroups or articles that provoke complaints from regular readers.

Bulk Emails and Harassment.

  • Sending unsolicited mass emails (i.e., to more than 25 users) that generate complaints from recipients.
  • Performing these actions with a non-Pro Certify Crew provider, using a Pro Certify Crew account for responses, or advertising a PBCOPL-hosted website.
  • Persisting in online harassment even after requests to stop from both the individuals and Pro Certify Crew.
  • Impersonating another user or falsifying one’s username in emails, Usenet postings, IRC, or any other Internet service. (This does not prohibit the use of nicknames in IRC or anonymous re-mailer services.)
  • PBCOPL forbids IRC programs, abuse scripts, and unauthenticated proxies, including open mail and anonymous web proxies.
  • Terminated users are responsible for labor costs to address complaints incurred by Pro Certify Crew.

Processor or RAM.

Users must not excessively use resources. Violations may lead to corrective actions, including terminating processes, disabling, or suspending accounts to maintain server stability.

Users cannot use 50%+ of system resources for more than 30 seconds, or exceed 2% CPU and 3% memory daily. Maximize efficiency: Limit to 10 processes at a time, each using up to 30 CPU seconds and 32MB of memory. Databases support up to 16 user connections.

Cron jobs should run no more than once every 30-minutes unless specified and must be nice to 15 or greater. Each cPanel account can send up to 150 emails per hour. Overuse of system resources may lead to temporary suspension to avoid server problems.

If an account is unsuitable for the shared or reseller server, we will notify the customer and offer alternatives like. ‘VPS’, ‘Dedicated Servers’, or a Premium Hosting account. Pro Certify Crew will determine violations and may adjust limits at its discretion.

Servers.

  • All unmetered dedicated and virtual private servers come with 100 Mbps shared bandwidth ports unless specified or requested as capped. Pro Certify Crew may monitor network usage and reduce speed for services that significantly exceed average usage to conserve resources. This typically excludes brief usage spikes but includes sustained high-bandwidth transfers. If a client’s data transfer rate impacts other clients, Pro Certify Crew may throttle the service.
  • RE-SELLER HOSTING ACCOUNTS cannot offer free services like web hosting, email, blogging, home pages, image hosting, or trial accounts.

Terms of Service We know free services are important to you. Unfortunately, we must impose some limitations due to various factors:

  • First, free services often lack a reliable way to identify registrants, making it hard to trace misuse.
  • Our customers, including re-sellers, value our prompt and reliable service, earning us a strong reputation. We cannot risk unidentified individuals damaging our reputation.
  • Users of free services frequently register for accounts to spam or consume large amounts of system resources and bandwidth. Often creating multiple accounts to continue their abuse, which causes significant issues for our servers and network.
  • Spammers, phishing and pharming scam operators, and distributors of malware, including spyware, viruses, Trojan horses, worms, and other malicious software. As well as illegal Warez site operators, unauthorized file-swapping or archive site operators, and hackers, frequently exploit free online services. Allowing free services would expose our servers to severe abuse, potentially harming us and all our customers. Including those of our re-sellers.
  • Free services can lead to abuses that may violate criminal laws or even support terrorist activities. As these abuses breach applicable laws and our policies, we must prohibit them.

Terms of Service: Violating this free service restriction may result in the immediate suspension of your account, with or without prior notice, at our sole discretion as necessary.

Terms of Service – Abuse of Pro Certify Crew Staff or Support Personnel: At Pro Certify Crew, we cherish the opportunity to serve you with the utmost dedication. We promise to treat every customer with the highest respect and courtesy, and we hope for the same in return.

If our staff continues to face abuse or disrespect, it deeply hurts us. Your account(s) may face suspension, and we strongly advise considering an alternative service provider. In such cases, you will receive a five (5) day notice before termination of service. We will issue a refund only for the unused portion of prepaid service. Identify and address abusive behavior, including the following actions:

Repeatedly addressing our staff in a demeaning or rude manner; using profanity in any oral or written communications with our staff by any medium, including but not limited to email, instant messages, chat, text messaging, fax, postal mail, telephone, Voice over Internet Protocol, or in-person communication; yelling or shouting at our staff; deliberately using all capital (uppercase) letters in any written communication to our staff; insulting our staff based on personal characteristics such as race, ethnicity, national origin, sex, sexual orientation, religion, or housing or economic status; or deliberately providing false information to our staff to harass them or waste their time.

Payment Problems in Terms of Service:

  1. User agrees to pay Pro Certify Crew all fees associated with the use of the User’s account(s) as per the rates and prices listed on the sales order at the time of commencement.
  2. The User bears the responsibility for any charges that arise while enjoying the service, and Pro Certify Crew holds the right to bill the User’s account whenever necessary.
  3. Pro Certify Crew reserves the right to suspend access to the service for the User’s account(s) in case of credit issues, including late payments or rejected charges.
  4. Please make sure to make your payments on time; even if you’re not using the service, the fees will continue unless you let us know through the help desk that you wish to cancel your membership at the end of your contract period. We’re here to help, so don’t hesitate to reach out! You can cancel your membership within the first 30 days for a full refund of your monthly fees. Our refund policy does not apply to additional items or services, including but not limited to Domain Registration, Domain Parking Services, SSL certificates, Dedicated Servers, Virtual Private Servers, and Overage Fees.

Terms of Service: Post the initial 30 days, you may cancel your account and receive a refund for the remaining contract period under our Any-Time Money-Back Guarantee.

  • Credit Card Payment: If the customer opts to pay by credit card, they authorize Pro Certify Crew to charge the card on each due date. The customer also agrees not to contest any hosting charges.
  • Non-Payment: All Reseller and Shared Hosting payments must be made in full by the billing terms anniversary date. Missing a payment on this date violates the TOS. If payment is not made within five (5) consecutive days, including the anniversary date, customer services may be suspended. If payment is not received within seven (7) consecutive days, including the anniversary date, access to the service network will be terminated and all services reclaimed. Customer data will be destroyed for security and privacy reasons after seven (7) days of non-payment.
  • All Dedicated Server and Virtual Private Server payments are due in full on the monthly anniversary date. If payment is not received within three (3) consecutive days, including the anniversary date, public access to customer services may be suspended. If payment is not made within five (5) consecutive days, including the anniversary date, access to the service network will be terminated and all services reclaimed.

Payment Notifications.

Our payment processor, Online Payment Gateway Partner, will remit payments for all recurring orders based on the billing terms anniversary date. It is the client’s responsibility to ensure sufficient funds are available in their payment account and that dues are paid on time. Additionally, the client must ensure the email address on file is functional and capable of receiving reminders from Online Payment Gateway Partner.

Once a payment reminder is dispatched from Online Payment Gateway Partner or Pro Certify Crew, it is considered a valid payment reminder. Online Payment Gateway Partner and Pro Certify Crew are not responsible for non-deliverable email addresses.

If emails sent by Online Payment Gateway Partner or Pro Certify Crew do not reach their destinations due to issues such as spam filters or network problems, it is not their responsibility. On the first day after a missed payment, you will receive a reminder notice to update your payment terms and pay your invoice from Online Payment Gateway Partner.

Second and third payment reminders will be sent on the third and fifth days. From the seventh day, customer services may be temporarily suspended for non-payment.

Public Feedback on Terms of Service:

Terms of Service: We require you to contact our Suggestions and Complaints Department before posting negative feedback about our company or employees. Failure to do so will result in immediate account termination without a refund.

While you have the right to post feedback without prior discussion with us, this approach is unfair and unprofessional. We value our clients and aim for their satisfaction. If you are unhappy, we ask that you first address your concerns with our Complaints Department. If you prefer to complain publicly right away, please do not sign up with Pro Certify Crew.

Furthermore, discussing your experience publicly nullifies any confidentiality policies, including our privacy policy, confidentiality agreement, and non-disclosure agreement. Posting negative comments publicly forfeits your privacy protection.

Refund Scenarios:

  • Pro Certify Crew offers a 30-day money-back guarantee on hosting service fees, preserving all other rights under this Agreement. If you cancel your account within thirty (30) days from the dispatch of your welcome email or the order date, whichever is earlier, Pro Certify Crew will refund your money with no questions asked. This refund is only available if you have not previously obtained a refund under the 30-Day Guarantee. If you have, your account will be canceled without a refund.
  • Changes to your service, such as adding or removing services or changing your hosting plan, do not qualify you for an additional 30-Day Money-Back Guarantee. This guarantee applies solely to your first web hosting service order from Pro Certify Crew and does not cover any subsequent service changes.
  • Our refund policy does not cover additional items or services, including but not limited to Domain Registration, Domain Parking services, SSL certificates, Dedicated Servers, Virtual Private Servers, and overage fees.

Account Cancellations:

  • Customers can cancel their account at any time, for any reason, by submitting a ticket to our Billing Department with the required details.
  • Pro Certify Crew requires a five (5) day notice for cancellations or downgrades of month-to-month services before the anniversary billing date. Failure to provide this notice will result in a full monthly charge before cancellation. All due amounts must be fully paid before we cancel the account.
  • Customer agrees that Pro Certify Crew does not offer pro-rated or any other refunds on cancellations. All fees paid are non-refundable unless stated otherwise under our any time money-back guarantee or 30-day money-back guarantee.
  • All cancellation requests must be made directly to the Pro Certify Crew Billing Department by opening a ticket. Cancellations will not be accepted via email, postal mail, or phone. If a customer cancels a recurring order through any third party, it will be considered an account cancellation request. In such cases, Pro Certify Crew reserves the right to terminate the account immediately, with or without prior notice.

Contract:

  • Pro Certify Crew may update these terms of service with a notice posted on Pro Certify Crew websites.
  • By continuing to use Pro Certify Crew services after such notice, the user accepts the changes to this Agreement.
  • This agreement, user account, contract, and billing will automatically renew unless canceled in writing before the renewal date.
